Spectra Logic warrants you that Spectra Certified Media products are free from defects in materials and workmanship, commencing from the time of purchase and for the Lifetime of the product. If during this time Spectra is notified of a defect, Spectra will replace the media in conjunction with the return of the defective media. Spectra’s Lifetime Guarantee applies to the normal working life of the media product, based upon the actual media manufacturer’s definition, which may be dependent on, for example, the number of passes, full backups, restores, or possible combination thereof.
This guarantee does not apply to defects caused by misuse, improper storage, normal wear and tear, or the media reaching the end of its normal working life. TO THE EXTENT ALLOWED BY LOCAL LAW, THE ABOVE WARRANTY IS EXCLUSIVE AND NO OTHER WARRANTY OR CONDITION, WHETHER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED AND HP SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICUALR PURPOSE.
This warranty gives you specific legal rights and you may also have other rights that vary from state to state, or province to province. THE REMEDIES PROVIDED IN THIS WARRANTY STATEMENT ARE CUSTOMER’S SOLE AND EXCLUSIVE REMEDIES. IN NO EVENT WILL HP OR ITS SUPPLIERS BE LIABLE FOR LOSS OF DATA, DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS) WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY.
